Legal situation in Germany:

Pepper sprays must be clearly labelled as ‘animal repellent spray’. In self-defence or emergency situations, pepper sprays, like other items within reach, may be used against human attackers to ward off a present, unlawful attack on oneself or another person. Proportionality must be maintained. However, anyone who uses pepper spray without being in serious danger is guilty of dangerous bodily harm and thus of a criminal offence. This also applies if the spray is used for too long or too intensively, i.e. if the perpetrator is already lying defenceless on the ground and continues to be sprayed out of fear, panic or even revenge. Animal defence sprays are not covered by the Weapons Act, are therefore not weapons and are freely available without age restrictions. Self-defence (StGB § 32 ff.): Anyone who commits an act that is necessary in self-defence is not acting unlawfully. Self-defence is the defence necessary to ward off a present unlawful attack on oneself or another person.
